GENERAL TERMS AND CONDITIONS (GTC)
ArcheQuant
1. Definitions
For the purposes of these General Terms and Conditions, the following definitions apply:
- ArcheQuant: the company operating the trading evaluation platform.
- Client / Trader: any individual or legal entity purchasing a service offered by ArcheQuant.
- Account: a simulated trading account provided as part of a Challenge or a Funded Account.
- Challenge: a simulated trading evaluation phase subject to predefined rules.
- Funded Account: a simulated funded account granted after successful Challenge validation or acquired directly (Instant Funded).
- Account Passing: a specific service performed by an independent commercial partner aiming to complete a Challenge.
- Partner: an independent third party offering Account Passing services.
- Platform: all technical tools, dashboards and interfaces provided by ArcheQuant.
2. Scope of Application
These GTC apply to all services provided by ArcheQuant without exception.
They prevail over any other document, communication or representation, including marketing or promotional content.
Any purchase implies full, unconditional and irrevocable acceptance of these GTC.
3. Nature of the Services
ArcheQuant exclusively provides:
- simulated trading services,
- trader skill evaluation services,
- performance and risk discipline analysis services.
3.1 No Real Capital
All accounts provided:
- contain no real capital belonging to the client,
- do not provide access to live financial markets,
- do not execute real market orders.
3.2 No Financial Product
The services offered:
- are not financial products,
- are not investment instruments,
- do not constitute asset management or portfolio management services.
4. Information and No Financial Advice
All information, tools, dashboards and communications provided by ArcheQuant:
- are for informational and technical purposes only,
- do not constitute financial advice,
- are not personalized investment recommendations.
The Client acts independently and under their sole responsibility.
5. Client Eligibility
The Client declares and warrants that they:
- are of legal age under applicable law,
- have full legal capacity to enter into contracts,
- understand the risks associated with trading,
- do not consider ArcheQuant as a financial intermediary.
Any false declaration may result in immediate termination of services.
6. Challenges – Detailed Terms
6.1 General Framework
Each Challenge includes:
- an initial simulated balance,
- predefined profit targets,
- daily and overall drawdown limits,
- strict risk management rules,
- consistency and behavioral constraints.
6.2 Contractual Rules
All Challenge rules:
- are disclosed prior to purchase,
- form an integral part of the contract,
- are deemed fully understood and accepted.
Any rule breach, intentional or not, results in immediate Challenge failure.
6.3 Maximum Loss Per Position (Stop Loss)
Across all accounts (challenge and funded), each open position must comply with a maximum allowed loss of 2% of the account's initial capital.
This means no Stop Loss may be set at a level that would result in a potential loss exceeding 2% of the account size.
Failure to comply with this rule constitutes a breach of the terms of use and may result in:
- automatic closure of the position,
- a warning or account breach,
- immediate Challenge failure or funded account suspension.
7. Funded Accounts (Simulated / Instant Funded)
7.1 Nature of Funded Accounts
A Funded Account (obtained after a challenge or direct purchase):
- remains a simulated account,
- is not a live trading account,
- grants no ownership rights over any capital.
7.2 Conditional Access
Access to a Funded Account:
- is never guaranteed,
- is subject to internal validation,
- may be revoked at any time in case of rule violations.
No vested right exists, even after allocation.
8. Account Passing Offers – Reinforced Clauses
8.1 Service Description
Account Passing is a separate commercial service whereby a Partner completes a Challenge on behalf of the Client.
It is an assistance and evaluation service, with no obligation of result.
8.2 Strict Prohibition of Client Trading During Account Passing
During the entire Account Passing phase:
- the Client has no operational access to the Account,
- the Client is strictly prohibited from placing, modifying or closing trades,
- any attempt to intervene constitutes a material breach.
The Client expressly acknowledges that they are not the trader of the Account during this phase.
8.3 End of Account Passing
The Client may trade:
- only after full Challenge validation,
- only after allocation of a Funded Account,
- only after acceptance of the applicable funded account terms.
Prior to this stage, no trading rights exist.
8.4 Partner Independence
Partners:
- operate independently,
- act in their own name and under their own responsibility,
- are neither employees, agents nor representatives of ArcheQuant.
ArcheQuant does not control nor influence Partner trading decisions.
8.5 No Delegated Management or Mandate
The Parties expressly acknowledge that:
- Account Passing does not constitute portfolio management,
- no management mandate is granted,
- no advisory or investment relationship is created.
9. Pricing, Payments and No Refund Policy
9.1 Payments
All payments are due immediately upon purchase.
Service execution begins once payment is confirmed.
9.2 Identity Verification (KYC) for Card Payments
Any payment made by credit/debit card (Visa, Mastercard, Apple Pay or any other non-crypto payment method) requires the Client to complete a KYC (Know Your Customer) identity verification process before any payout request can be processed.
This verification is mandatory and is a prerequisite for processing any withdrawal request. ArcheQuant reserves the right to refuse or suspend a payout until the KYC procedure has been successfully completed.
9.3 No Refunds
Unless expressly stated otherwise:
- no refunds are granted,
- no credits or compensation apply,
- Challenge failure does not entitle the Client to reimbursement.
10. Suspension, Termination and Sanctions
ArcheQuant reserves the right to:
- suspend any Account without prior notice,
- permanently terminate access,
- refuse future services,
in case of:
- fraud or attempted fraud,
- rule circumvention,
- abusive behavior,
- system manipulation attempts.
11. Limitation of Liability
ArcheQuant's liability is strictly limited to:
- the amount paid for the relevant service.
ArcheQuant shall not be liable for indirect damages, loss of profit or loss of opportunity.
12. Personal Data
Personal data is processed in accordance with the Privacy Policy available on the Platform.
No data is used for trading advice or financial profiling purposes.
13. Intellectual Property
All content, tools, rules and interfaces provided by ArcheQuant are protected by intellectual property laws.
Any unauthorized use is strictly prohibited.
14. Service and Rule Modifications
ArcheQuant reserves the right to:
- modify rules for future purchases,
- update or improve its services.
No modification applies retroactively to active services, with the following exceptions:
14.1 Retroactive Consistency Recalculation
Consistency metrics (validated days, consistency excess, objective bonus) may be retroactively recalculated across all past trades when calculation rules are updated. This recalculation ensures fairness and accuracy for all active accounts.
The Client acknowledges and accepts that:
- the number of validated consistency days may be recalculated upward or downward,
- the objective bonus linked to consistency excess may be recalculated,
- these recalculations apply automatically to all active accounts, including those under evaluation or funded trading.
15. Force Majeure
ArcheQuant shall not be held liable for failure or delay resulting from force majeure events, including but not limited to:
- major technical failures,
- server outages,
- events beyond its reasonable control.
16. Governing Law and Jurisdiction
These GTC are governed by the law applicable in the jurisdiction where the company operating ArcheQuant is registered.
Any dispute falls under the exclusive jurisdiction of the competent courts of that jurisdiction.
17. Final Acceptance
By placing an order, the Client acknowledges that:
- they understand the simulated nature of the services,
- no performance or profit is guaranteed,
- they waive any attempt to reclassify the services as regulated financial activities.
